Family reunification of a foreign citizen

If you have been granted temporary residence for a period of minimum one year, or long-term residence in Romania, then you can become a sponsor for your family members, who can join you.

It might be possible that you are the family member left in the country of origin, and for that reason sometimes this text is written in the first person, and sometimes in the third person.

It is important to know that the duration of your right of residence can be even less than one year-long, if you have been granted temporary residence on scientific research activities grounds, or if you are the holder of an EU Blue Card, an ITC permit, or a “mobile” ITC.

On a side note, please be mindful that this sponsorship cannot be granted to you if you yourself have obtained a temporary residence permit for family reunification purposes.

As a general rule, family reunification is a preliminary procedure that you will have to go through in Romania whereby you are approved (or not) for family reunification with family members that you want to bring to Romania.

Your family relationship with the foreign national – your family member – must be proven by means of a civil registration document that will require you first to go through the supra-legalization procedure, described on the page Your trip to Romania.

LEGAL PREREQUISITES AND DOCUMENTS REQUIRED FOR FAMILY PRE-REUNIFICATION PROCEDURE, REGARDLESS OF THE CONTEMPLATED FAMILY MEMBER TO JOIN YOU

You can apply for family reunification only for the following categories of family members:

– spouse

– single underage children of the sponsor or spouse, including any adopted children

– single underage children of the sponsor or spouse, including any adopted children, who are dependent on the sponsor and in relation to whom the sponsor or spouse exercises parental rights; if parental rights are exercised jointly, the consent of the other holder of parental rights is required;

– the sponsor’s or spouse’s parents, if they are unable to support themselves and do not enjoy adequate family support in the country of origin;

– single adult children of the sponsor or spouse, if they cannot support themselves for medical reasons;

– you are the parent, legal guardian or relative of an unaccompanied underage person who is in Romania and has obtained refugee status or subsequent protection.

The legal prerequisites and documents required to obtain prior approval for family reunification purposes are:

– application (form is being provided by the authorities)

– travel document of the family member for whom family reunification is requested (copy) and a recent colour photo (passport type)

– Marriage certificate or, if applicable, proof of family relationship (original and copy, after the document is supra-legalized, translated into Romanian and the translation notarized in Romania)

– sponsor’s declaration (provided before a notary public) that you will be living together, that there is no bigamy or polygamy relationship, that the sponsor will support the family member

– sponsor’s residence permit in Romania (original and copy)

– proof of accommodation (original and copy, to be provided by the Romanian national)

– proof of financial support – at least equivalent to the minimum gross benchmark salary in the country and actually paid, besides the resources necessary to cover the sponsor’s own living costs, for a period of 3 months; please note that for 2022 the monthly amount is RoN2,200.  

– proof of the sponsor’s public health insurance coverage

– declaration by the person who has joint custody of the under age child for whom family reunification is requested, giving their consent to the underage child’s living with the sponsor in Romania.

– fees and costs: No fees are applicable for this procedure

The application for family reunification purposes will be processed within 90 days.

The sponsor is notified of the approval on a special form which is sent to the family member, who will use it when applying for a long-stay visa for family reunification purposes.

LEGAL PREREQUISITES AND DOCUMENTS REQUIRED FOR OBTAINING RESIDENCE IN ROMANIA FOR THE PURPOSE OF FAMILY REUNIFICATION – MARRIAGE WITH A FOREIGN NATIONAL

– application (form is being provided by the authorities)

– travel document (original and copy)

– marriage certificate delivered by the competent authorities (original and copy, after the document is supra-legalized, translated into Romanian and the translation notarized in Romania)

– sponsor’s declaration (provided before a notary public) that you will be living together, that there is no bigamy or polygamy relationship, that the sponsor will support the family member

– proof of financial support – at least equivalent to the actually paid minimum gross benchmark salary in the country, besides the resources necessary to cover the sponsor’s own living costs, for a period of  12 months; please note that for 2022 the monthly amount is RoN2,200. 

– proof of accommodation (original and copy, to be provided by the Romanian national)

– proof of the sponsor’s public health insurance coverage

– medical certificate attesting that you do not suffer from any medical conditions that could pose a hazard to public health

– fees and costs: proof of payment of the €120.00 consular fee and the residence permit fee in amount of RoN259.00 respectively.

The temporary right of residence for this purpose is extended individually to each family member for the same duration for which the right of residence was granted to the sponsor.

If the sponsor holds a long-term right of residence, then the right of residence of each family member may be extended for periods of up to 5 years.

LEGAL PREREQUISITES AND DOCUMENTS REQUIRED FOR OBTAINING RESIDENCE IN ROMANIA FOR THE PURPOSE OF FAMILY REUNIFICATION – OTHER FAMILY MEMBERS OF THE FOREIGN NATIONAL

The legal prerequisites and necessary documents are:

– application (form is being provided by the authorities)

– travel document (original and copy)

– birth certificate or any other civil registration documents underlying family relationship delivered by competent authorities (original and copy, after the document is supra-legalized, translated into Romanian and the translation notarized in Romania)

– sponsor’s declaration (provided before a notary public) that you will be living together, that there is no bigamy or polygamy relationship, that the sponsor will support the family member

– statutory declaration before a notary public, or document delivered by a medical organisation, as the case may be

– proof of financial support – at least equivalent to the actually paid minimum gross benchmark salary in the country, besides the resources necessary to cover the sponsor’s own living costs, for a period of 12 months; please note that for 2022 the monthly amount is RoN2,200. 

– proof of accommodation (original and copy, to be provided by the Romanian national)

– proof of the sponsor’s public health insurance coverage

– medical certificate attesting that you do not suffer from any medical conditions that could pose a hazard to public health

– fees and costs: proof of payment of the €120.00 consular fee and the residence permit fee in amount of RoN259.00 respectively.
